Contents of a Title Status Report (TSR)

A Title Status Report is a report used to report the current ownership status of a particular tract of land.

The Land Title and Records Office (LTRO) regularly issue these reports to agencies and other interested parties either as certified (title examination conducted and Manager signature present on report) or uncertified (title examination not conducted and Manager signature not present) reports.

Title Status Report means a report issued after a title examination that shows the proper legal description of a tract of Indian land; current ownership, including any applicable conditions, exceptions, restrictions, or encumbrances of record; and whether interests in the land are in unrestricted, restricted, trust, and/or other status as indicated by the record of title in the LTRO.

TSRs are accurate only at the time they are printed or certified based on information available to the BIA. If death records are not available to the BIA, probates cannot be completed, and the TSR could reflect an inaccurate number of allotment beneficiaries and is not released to the public.

A Title Status Report is subdivided into three (3) basic parts:

1. Land Legal Description Information, Title Status Information and Certification Signature
2. Owner/Fractional Interests Information
3. Realty/Encumbrance Information

1. Land/Tract Legal Description

A. Land Area Code (LAC);
B. Name of Land Area (aka Reservation area) – corresponds with Land Area Code (LAC);
C. Current tract/allotment number;
D. LTRO responsibility for land title maintenance
E. The Agency with responsibility for the Tribes;
F. The Regional Office with responsibility for the Agency;
G. Resources Code: Surface, Mineral, Both
H. Current Section/Township/Range the land is located in;
I. State the land is located in;
J. County the land is located in;
K. Meridian the land is located in;
L. Aliquot legal land description;
M. Number of acres in tract;
N. Title Status of the tract (includes Tract Notes, if any);
O. Signature of Certifying Official;
P. Certification Date and Time;

2. Owner/Fractional Interests

A. All current owners identified by appropriate reservation code and tribe, individual identification numbers, Indian/Non-Indian status, title status of land, and interest type information;
B. The document class, type and number from which fractional interests are received;
C. The owner name as specifically identified in the document from which an interest is acquired;
D. The fractional interest of each acquired fractional interest (usually reduced to the lowest
terms);
E. The aggregated fractional interest (always identified as a common denominator) and decimal equivalent owned by individual owners/Tribes;
F. The total sum of all fractional interest/decimal equivalents (must always equal unity – 1/1);
G. Any special interests owned by beneficiaries/Tribes (i.e. life estates, joint tenancies, etc.);

3. Realty/Encumbrance

A. Listing of realty documents affecting the land;
B. Listing of encumbrances/liens affecting the land.
